Cruelty used to be ground of divorce and judicial separation under Hindu, Christian and Parsi Civil laws. Indian Penal Code dealt with it in a limited way. It was confined till dowry harassment, physical and mental cruelty under the Dowry Prohibition Act, 1961 and Section 498-A of Indian Penal Code. The definition of cruelty under Section 498-A was vague and not comprehensive one. The domestic violence used to be considered a private affair. The Protection of Women From Domestic Violence Act, 2005 has filled up the gap and rights of women in the household stand recognized by this legislation. The concept of equality between man and women is slightly taking birth with enactment of this significant Act. This Act is a beneficent piece of legislation for fighting human rights of women.

Non-Legal Modes of Redressal of Violence

Non-legal mechanisms of redressal for responding to violence are important resources for survivors of violence. These are not only the first point of contact for the majority of survivors, but are important sources of strength and understanding in what is often a long process in achieving justice. Women or girls may call upon family members or friends to discuss the problem, or look for guidance from their community or religious leaders to think about what to do next. They may rely on personal coping mechanisms to deal with difficult situations, or look to organizations and groups that work with issues dealing with the specific problems that are affecting them, such as women’s organizations or NGOs. Women and girls with disabilities may seek professional services with counsellors, therapists, and doctors to address trauma, injuries or illness resulting from their experiences of violence. This module of the Legal Literacy Manual will help the reader understand: 1. Non-legal modes of responding to violence against Women and Girls with Disabilities; 2. Recognize the importance of non-legal modes of responding to violence against Women and Girls with Disabilities; 3. Know when the non-legal modes of responding to violence against Women and Girls with Disabilities should be used; 4. Elaborate on the kinds of non-legal modes of redressal of violence against women and girls with physical disabilities. The Legal Literacy Manual is an outcome of a Centre for Women’s Development Studies (CWDS) Project titled ‘Violence against Women and Girls with Physical Disabilities in India: Understanding the Issues and Promoting Legal Empowerment’. This research-cum-advocacy initiative was supported by a two-year grant (2017-2019) from the Women’s Fund Asia (WFA) formerly South Asia Women’s Fund (SAWF). It is perhaps the first such context-specific training tool designed for girls and women with physical disabilities in India. Professor Renu Addlakha conceptualized the entire endeavor and was also the Project Director.

Violence against women is now widely recognized as an important social and legal problem considering the social impact. Violence against women among many Indian communities on a regularly basis goes unreported. This paper will focus on prevalence and other related issues of various forms of domestic violence against women during the lockdown period of COVID 19 pandemic Violence against women in India is an issue rooted in societal norms and economic dependence. From sati-pratha to sexual harassment at workplace and female feticide, domestic violence other forms of gender-based violence constitute the reality of most girls' and women's lives in India. Wife battering affects the physical and psychological wellbeing of the abused women and even that of their children. Although female participation in public life is increasing and laws have been amended, India still has a long way to go to make Indian women equal citizens in their own country. In our society, many women are viciously treated by their intimate partners while they suffer in silence. In some cases, domestic violence leads to the death of these women. It is on this premise that this paper discusses the meaning, causes, and types of domestic violence and after-effects of these types of violence on abused women. It is also important to understand that not all forms of domestic abuse are physical violence. In addition, the paper discusses about role of law, judiciary and the role to be played by the social workers, professionals and other voluntary organizations in providing intervention to the affected individuals.
